LIVE SUES FORMER LEAD SINGER FOR $2 MILLION

The three remaining members of the band Live -- guitarist Chad Taylor, drummer Chad Gracey and bassist Patrick Dahlheimer -- are suing former lead singer Ed Kowalcyzk to make sure he does not use the band's name on his own. According to Billboard, they are also seeking an injunction and $2 million in statutory damages for trademark infringement, trademark dilution and false designation of origin. They claim that Kowalcyzk is using the band name in ads for his own concerts and misrepresenting to the public that he is still in the group.

 

  • The suit also claims promoters, booking agents and venues are being led to believe Kowalcyzk is still in the band despite leaving in 2009.
  • To add to the possible confusion, Kowalcyzk released a solo album called Alive in 2009. The other members of Live recorded an album with two members of Candlebox under the name The Gracious Few.
  • Taylor wrote a letter to fans last year regarding Kowalcyzk's departure, in which he said, "We can sympathize with your angst surrounding Ed's departure. His magical lyrics touched all of our lives for so many years. On many levels he can never be replaced. Only Ed can determine his future and right now he is unresponsive regarding Live; so we must move forward without him."
  • Live regrouped with a new lead singer named Chris Shinn earlier this year, although touring and recording plans have yet to be finalized.

  • The members of Live met in high school in York, Pennsylvania and originally called themselves Public Affection.
  • The band landed a record deal in 1991 and changed its name to Live, issuing its debut disc, Mental Jewelry, that year.
  • Live's second album, 1993's Throwing Copper, was a commercial smash, selling eight million copies and featuring the hits "All Over You," "I Alone," "Lightning Crashes" and "Selling The Drama."
  • The band's last album of all new material, Songs From Black Mountain, came out in 2006.
