General Contest Rules

Prize

Non-cash prizes are not redeemable for cash. WMMR reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Unless otherwise stated in the specific contest rules, any prize won will not be mailed under any circumstances and winners must claim their prizes in person at the WMMR offices within 30 days after the end of the contest, and can only do so Monday through Friday between the hours of 8:30am to 5:30pm (excluding holidays. Also, the day before and after a holiday we sometimes close early, so check with the Promotion Department if you plan on coming in on a weekday before or after a holiday). Prizes not claimed within the stated period will be forfeited.

Eligibility

All entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Arbitron).  A winner will be disqualified if he/she or a member of his/her household has won a WMMR contest with a value over $50.00 within the previous 60 days or a Greater Media Philadelphia (WBEN-FM, WMGK, WMMR, WPEN) contest with a value of $1000 or more within the previous 365 days.  Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, its affiliates, promotion sponsors, advertising and promotional agencies who do business with WMMR or any of the promotion sponsors, and other radio stations in WMMR’s metro survey area are not eligible to participate in any contest presented by WMMR.  The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.”  Limit one entry per person; multiple entries will disqualify the entrant.  Void where prohibited.

Release

By entering, all participants  release and hold harmless the promotion sponsors, WMMR, Greater Boston Radio, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won.  Winners (and their guests, if any) will be required to sign a form releasing WMMR and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.  

Disclaimer

WMMR undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s).  WMMR is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station.  WMMR is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.  If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of WMMR, Station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).

License

Entry into any contest constitutes full permission for WMMR and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

Taxes

If required by applicable law, WMMR will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099.  Winners must provide their social security number to WMMR for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize. 

General

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won.  WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates.  WMMR reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement.  By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding.  Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.  

As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and WMMR hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

On-air/call-to-win/text-to-win contests  
 
Online listeners to the WMMR web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in our on-air contests. Winner qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call.   Contest calls will not be accepted at any other number. 
 
For WMMR, the text short code is 39333, texting contexts in which the listener must be a certain number texter to win (e.g., the 100th person to text in), unless otherwise noted, the correct texter must answer their mobile phone when called or another winner will be selected. For all texting contests, standard texting charges by your mobile phone carrier will apply. For all WMMR contests that permit listeners to enter by texting the station, listeners will also have the option to enter online at the following URL: www.vibescm.com/amoe.  Unless the rules state otherwise, contest entries are limited to one per person for the entire contest, regardless of the entry method.  Listeners who enter online will be required to provide the WMMR short code (39333), the contest keyword associated with the specific contest (or the one announced on air by the WMMR DJ, which may vary per contest), and the entrant's first and last name and phone number.  For security purposes, online entrants will be required to enter the code word(s) shown on the entry page before completing their entry.  All web and text entries will be pooled together and a winner(s) will be chosen from that pool in accordance with the contest rules.
 
Song of the Day contests:
 
Only the specific Song of the Day, when played in its entirety from beginning to end, will be used to solicit contest calls.  Snippets of songs played for advertising or promotional purposes and music beds that contain music from the Song of the Day WILL NOT count.  Listeners should try to be the Xth caller at 215-263-WMMR (39333) as soon as they hear the Song of the Day begin to play.  (If a listener accidentally calls when a song snippet or music bed is played, s/he will simply be informed of the error.)

WMMR’s Word of the Week Contest Rules

How to Enter for a Chance to Win:
Each weekday, WMMR’s Preston & Steve will announce the “Daily Letter” (a letter of the alphabet) near the end of their show, between 10am and 10:45am (times vary depending on the end time of that day’s show). On Friday of each week (or the last weekday on which Preston & Steve broadcast live that week, in the event of a holiday or vacation), listeners will be encouraged to call 215-263-WMMR (9667) after that day’s “Daily Letter”. The first Randomly selected caller to correctly identify the “Word of the Week” created by each of that week’s “Daily Letters” will be the winner of that week’s prize.

Prize
Each Week’s prize is different, listen to the Preston & Steve Show for prize details. Winners are responsible for any costs associated with a prize that are not specifically noted as being part of the prize including but not limited to meals, tips, transportation, port fees and more.

How to Enter and Win

Listeners will have the opportunity to enter by visiting WMMR.com’s Home Page at different times throughout the year.  Listen to 93.3 WMMR or visit our website at www.wmmr.com for details.  Each entrant may submit up to 10 digital photos of themselves per contest by emailing them to Hottie@wmmr.com or by going to WMMR.com and clicking on the appropriate link.  Deadlines for submissions will be announced during weekday mornings on the Preston & Steve Show, or call 610-771-0933 and ask for someone in MMR Promotions for details.  All entries must be received by the stated deadline.  Photos must be in .jpg or .gif format, with a maximum file size of 1MB.  If chosen as a contestant, the entrant will become eligible for their picture(s) to be voted upon at WMMR.com.  WMMR Judges will determine the winner in conjunction with the votes cast.  By entering the contest, you grant WMMR a perpetual, royalty-free license to post your submitted photo(s) online and to use it for promotional purposes.

IMPORTANT NOTE:  WMMR reserves the right to reject photos in its sole discretion.  All submissions should be in good taste and may not depict actual or simulated sexual acts or nudity.  Photos displaying full or partial nudity, “crotch” shots, or any image that focuses on the pelvic area will be rejected.

Prize

For each individual “Preston and Steve’s Hottest” contest, the following prizes will be awarded.  Prize list will be updated from time to time and/or described on-air and on the Preston & Steve website for specific contests.  Prizes may vary somewhat by “hottest” category; listen to 93.3 WMMR or visit our website at www.wmmr.com for additional prize details, if applicable. 

1st Place: $1,000 (total) in prizes and gift certificates from Steven Singer Jewelers, a professional photo shoot and other prizes that are added each time a new category is announced. One (1) first-place prize will be awarded for each “hottest” category.  Photos taken at the professional photo shoot that is part of the 1st place prize will become the sole property of WMMR. WMMR will provide paper and/or digital copies of the photos for the winner to use at her discretion, but the winner will not have any approval rights with respect to WMMR’s use of the photos.  By accepting the first-place prize, all winners grant WMMR irrevocable permission to use and display their image, as displayed in the professional photos, online, including on WMMR social media pages, and for other promotional purposes in WMMR’s sole discretion.

ERV: $2,000 (exact value depends on the specific prizes awarded)

2nd Place: $250 in cash or company check.  One second-place prize will be awarded per “hottest” category.

3rd Place: a pair of tickets and dinner for two at Helium Comedy Club, 2031 Sansom St, Philadelphia, PA 19103.  Dinner awarded as $75 gift certificate to Helium.  ERV: $125.  One third-place prize will be awarded per “hottest” category.

How to Enter for a Chance to Win

The contest will begin on Monday, March 31, 2014 and will run weekdays through Friday, April 18, 2014. 

Each weekday during the contest period, at approximately 8am, Noon, and 4pm (ET), listen to 93.3 WMMR to hear the Cue to text in the “Word of the Hour”. When the Cue airs, text the specified Word of the Hour (as announced in the Cue to text) to 89448.  Standard message and data rates may apply.  To enter without sending a text, go to the contest page at www.wmmr.com to fill out and submit the online entry form and Word of the Hour.  Each entrant who texts or submits online the correct Word of the Hour within 15 minutes after the Cue to text airs will qualify for that hour’s drawing for a chance to win $1000.  WMMR listeners will be competing with listeners from other Greater Media Philadelphia stations, who will also receive a “cue to text” at the same time and will be submitting their entries during the same 15-minute period.

One (1) winner will be chosen at random at the end of the 15 minute period from all eligible entries received during that entry period (including entries from other Greater Media Philadelphia stations).  Initially-selected winners are subject to confirmation of eligibility in accordance with these rules.

Entrants will only be eligible for the $1000 drawing for the hour in which they entered.  Initially-selected $1000 winners will be notified via phone call (at the mobile number from which the winning text was received or at the phone number listed in the online entry form) at approximately 8:30am, 12:30pm and 4:30pm on the day that they entered, and must confirm notification and acceptance of prize within three (3) business days or risk forfeiture of the prize and selection of a new winner.  Listeners may send or submit a maximum of one entry per Cue to text, for a maximum of three (3) entries per day.

Listening to WMMR’s over-the-air broadcast is the best way to participate in the on-air portion of this contest.

If there is any dispute about the identity of a text entrant, the registered user of the text message account on the date of entry will be the recognized entrant.  All participants acknowledge that messages are distributed by third-party mobile network providers and WMMR (Station) cannot control certain factors relating to message delivery.  Participants acknowledge that, depending on the recipient’s mobile provider service, it may not be possible to transmit the message to the recipient successfully.  Station assumes no responsibility for, and does not guarantee in any way, the availability or performance of any mobile, text or data service, including liability for transmission delays or message failures.

Station does not charge a fee for text entries.  It is each entrant’s responsibility to check with their individual carrier and mobile/data plan, as other charges may apply.  PLEASE BE ADVISED THAT TEXTS TO THE STATION MAY RESULT IN ONE OR MORE AUTOMATIC BOUNCE BACK MESSAGES, FOR WHICH PARTICIPANTS MAY INCUR A FEE FROM THEIR PROVIDER.  Station assumes no responsibility for charges incurred for text-messaging, including (without limitation) charges resulting from any bounce back messages or contest notices from the Station.  Only those text messages sent to the specific phone number provided, at the time texting is solicited, with the correct Word of the Hour, will be eligible to win. Texting to the main Station phone number or any other phone number are not eligible. 

Prizes & Restrictions

Forty-five (45) prizes will be awarded during the contest period, each consisting of $1,000.  Prize will be awarded in the form of a check from Greater Media Philadelphia and will be available within 30 days of confirming winner’s eligibility.  If a winner is determined to be ineligible, s/he will be disqualified and the prize will not be awarded.

Odds of being selected as a winner depend on the total number of eligible entries received by all Greater Media Philadelphia stations for the specific Cue to text/Word of the Hour, by text and online.  Greater Media Philadelphia reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value.  Prize winners may not request prize substitution.  Prizes are non-transferable and may not be claimed or used by any person other than the winner.  Winners must claim their prizes by completing all required paperwork in person at the Greater Media Philadelphia office within 60 days after the end of the contest.  Prizes not claimed within the 60-day period will be forfeited.  All taxes, including but not limited to federal, state, and local taxes, and any other costs and expenses associated with acceptance or use of prize are the sole responsibility of the winner.

Entry into any contest constitutes full permission for WMMR, Greater Media Philadelphia and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

Taxes

Greater Philadelphia Radio, Inc. will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099.  Winners must provide their social security number to WMMR, Greater Philadelphia Radio, Inc. for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize. 

General

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on the contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won.  WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates.  WMMR reserves the right to make changes in the contest rules at any time, which changes will become effective upon announcement.  By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding.  Copies of written contest rules and the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004 for 60 days after the contest concludes. 

As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, PA having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and Greater Media Philadelphia hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.
