General Contest Rules

Prize

Non-cash prizes are not redeemable for cash. WMMR reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Unless otherwise stated in the specific contest rules, any prize won will not be mailed under any circumstances and winners must claim their prizes in person at the WMMR offices within 30 days after the end of the contest, and can only do so Monday through Friday between the hours of 8:30am to 5:30pm (excluding holidays. Also, the day before and after a holiday we sometimes close early, so check with the Promotion Department if you plan on coming in on a weekday before or after a holiday). Prizes not claimed within the stated period will be forfeited.

Eligibility

All entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Arbitron).  A winner will be disqualified if he/she or a member of his/her household has won a WMMR contest with a value over $50.00 within the previous 60 days or a Greater Media Philadelphia (WBEN-FM, WMGK, WMMR, WPEN) contest with a value of $1000 or more within the previous 365 days.  Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, its affiliates, promotion sponsors, advertising and promotional agencies who do business with WMMR or any of the promotion sponsors, and other radio stations in WMMR’s metro survey area are not eligible to participate in any contest presented by WMMR.  The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.”  Limit one entry per person; multiple entries will disqualify the entrant.  Void where prohibited.

Release

By entering, all participants  release and hold harmless the promotion sponsors, WMMR, Greater Boston Radio, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won.  Winners (and their guests, if any) will be required to sign a form releasing WMMR and its affiliated companies from all liability in connection with the contest and the award and use of the prize before claiming the prize.  

Disclaimer

WMMR undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s).  WMMR is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station.  WMMR is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.  If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of WMMR, Station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).

License

Entry into any contest constitutes full permission for WMMR and promotion sponsors and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.

Taxes

If required by applicable law, WMMR will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099.  Winners must provide their social security number to WMMR for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize. 

General

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won.  WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates.  WMMR reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement.  By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding.  Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.  

As a condition to participating in this Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and WMMR hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

On-air/call-to-win/text-to-win contests  
 
Online listeners to the WMMR web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in our on-air contests. Winner qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call.   Contest calls will not be accepted at any other number. 
 
For WMMR, the text short code is 39333, texting contexts in which the listener must be a certain number texter to win (e.g., the 100th person to text in), unless otherwise noted, the correct texter must answer their mobile phone when called or another winner will be selected. For all texting contests, standard texting charges by your mobile phone carrier will apply. For all WMMR contests that permit listeners to enter by texting the station, listeners will also have the option to enter online at the following URL: www.vibescm.com/amoe.  Unless the rules state otherwise, contest entries are limited to one per person for the entire contest, regardless of the entry method.  Listeners who enter online will be required to provide the WMMR short code (39333), the contest keyword associated with the specific contest (or the one announced on air by the WMMR DJ, which may vary per contest), and the entrant's first and last name and phone number.  For security purposes, online entrants will be required to enter the code word(s) shown on the entry page before completing their entry.  All web and text entries will be pooled together and a winner(s) will be chosen from that pool in accordance with the contest rules.
 
Song of the Day contests
 
Only the specific Song of the Day, when played in its entirety from beginning to end, will be used to solicit contest calls.  Snippets of songs played for advertising or promotional purposes and music beds that contain music from the Song of the Day WILL NOT count.  Listeners should try to be the Xth caller at 215-263-WMMR (39333) as soon as they hear the Song of the Day begin to play.  (If a listener accidentally calls when a song snippet or music bed is played, s/he will simply be informed of the error.)

WMMR’s Word of the Week Contest Rules

How to Enter for a Chance to Win:
Each weekday, WMMR’s Preston & Steve will announce the “Daily Letter” (a letter of the alphabet) near the end of their show, between 10am and 10:45am (times vary depending on the end time of that day’s show). On Friday of each week (or the last weekday on which Preston & Steve broadcast live that week, in the event of a holiday or vacation), listeners will be encouraged to call 215-263-WMMR (9667) after that day’s “Daily Letter”. The first Randomly selected caller to correctly identify the “Word of the Week” created by each of that week’s “Daily Letters” will be the winner of that week’s prize.

Prize
Each Week’s prize is different, listen to the Preston & Steve Show for prize details. Winners are responsible for any costs associated with a prize that are not specifically noted as being part of the prize including but not limited to meals, tips, transportation, port fees and more.

How to Enter and Win

Listeners will have the opportunity to enter by visiting WMMR.com’s Home Page at different times throughout the year.  Listen to 93.3 WMMR or visit our website at www.wmmr.com for details.  Each entrant may submit up to 10 digital photos of themselves per contest by emailing them to Hottie@wmmr.com or by going to WMMR.com and clicking on the appropriate link.  Deadlines for submissions will be announced during weekday mornings on the Preston & Steve Show, or call 610-771-0933 and ask for someone in MMR Promotions for details.  All entries must be received by the stated deadline.  Photos must be in .jpg or .gif format, with a maximum file size of 1MB.  If chosen as a contestant, the entrant will become eligible for their picture(s) to be voted upon at WMMR.com.  WMMR Judges will determine the winner in conjunction with the votes cast.  By entering the contest, you grant WMMR a perpetual, royalty-free license to post your submitted photo(s) online and to use it for promotional purposes.

IMPORTANT NOTE:  WMMR reserves the right to reject photos in its sole discretion.  All submissions should be in good taste and may not depict actual or simulated sexual acts or nudity.  Photos displaying full or partial nudity, “crotch” shots, or any image that focuses on the pelvic area will be rejected.

Prize

For each individual “Preston and Steve’s Hottest” contest, the following prizes will be awarded.  Prize list will be updated from time to time and/or described on-air and on the Preston & Steve website for specific contests.  Prizes may vary somewhat by “hottest” category; listen to 93.3 WMMR or visit our website at www.wmmr.com for additional prize details, if applicable. 

1st Place: $1,000 (total) in prizes and gift certificates from Steven Singer Jewelers, a professional photo shoot and other prizes that are added each time a new category is announced. One (1) first-place prize will be awarded for each “hottest” category.  Photos taken at the professional photo shoot that is part of the 1st place prize will become the sole property of WMMR. WMMR will provide paper and/or digital copies of the photos for the winner to use at her discretion, but the winner will not have any approval rights with respect to WMMR’s use of the photos.  By accepting the first-place prize, all winners grant WMMR irrevocable permission to use and display their image, as displayed in the professional photos, online, including on WMMR social media pages, and for other promotional purposes in WMMR’s sole discretion.

ERV: $2,000 (exact value depends on the specific prizes awarded)

2nd Place: $250 in cash or company check.  One second-place prize will be awarded per “hottest” category.

3rd Place: a pair of tickets and dinner for two at Helium Comedy Club, 2031 Sansom St, Philadelphia, PA 19103.  Dinner awarded as $75 gift certificate to Helium.  ERV: $125.  One third-place prize will be awarded per “hottest” category.

Winners will be required to complete a Liability/Publicity Release Form at the time of pick up and must present valid photo ID. Some prizes take time to get into the station.

WMMR “First Niagara P&S Camp Out” Official Contest Rules

How to Enter for a Chance to Win

Pick up a specially marked Camp Out for Hunger Access Card at participating Philadelphia area First Niagara Branch locations between 11/5/14 and 12/4/14.  Limit one Access Card per person (total).  Then, visit Preston and Steve’s Camp Out for Hunger (located outside in the parking lot of Xfinity Live! Philadelphia, 1100 Pattison Avenue, Philadelphia, PA 19148) between 12/1/14 and 12/5/14 during the following hours only: 12/1 thru 12/4 between 6am and 6pm; 12/5 between 6am and 11am.  Each access card is good  for one attempt to enter a 5-digit code into the Prize Vault game at Camp Out for Hunger.

A predetermined grand prize winning five (5) digit number has been randomly selected for this contest by an independent promotions company, Odds On Promotions (OOP), and programmed into the Prize Vault that will be used for all contest attempts.  Each eligible participant will be given a maximum of one opportunity to attempt the contest.  Attempts will be made on a first-come, first-served basis during the Camp Out for Hunger.

Each participant will give their five (5) digit number to the WMMR contest administrator on-site at the Prize Vault.  The administrator will enter the number into the Prize Vault.  Each submitted number guess must fall between the range 00000 – 99999, and digits may repeat within the number sequence.  Once the number is entered, no changes can be made to the guess. 

The Prize Vault will display if the participant selected the winning number or not.  If the correct Grand Prize winning number is entered, the Prize Vault will no longer accept guesses for the Grand Prize, but the contest will continue for chances to win Secondary Prizes only, unless and until all 20 Secondary Prizes have been won. 

In order to qualify for prize reimbursement, an eligible participant must guess a number that matches the preselected winning number EXACTLY IN SEQUENCE. The memory logs of the Prize Vault are the sole determiner of whether or not the participant is a prize winner. Neither the visual/graphic display nor the audio output of the machine will be considered in determining a winner.  Neither WMMR nor Odds on Promotions (OOP) is responsible for any prize reimbursement resulting from machine malfunction.

IMPORTANT: OPENING AND/OR TAMPERING WITH THE PRIZE VAULT IS STRICTLY PROHIBITED. Evidence of entry or any act or submission that changes the functionality of the Prize Vault will cause a prize claim to be denied..

One total Prize Vault attempt per person, multiple entries are NOT permitted. All prize awards are subject to confirmation by the prize provider.

No donation is required to receive an Access Card or attempt the Prize Vault game.  All donations will be delivered directly to Philabundance, an organization dedicated to driving hunger from our communities.

Prize

If the correct Grand Prize winning number is properly entered into the Prize Vault in compliance with these Official Rules, one (1) Grand Prize will be awarded.  If the one (1) available Grand Prize is won in accordance with these Rules, the Grand Prize portion of the contest will officially end at the time the Grand Prize is won. If no participant successfully enters a number that matches the preselected winning number EXACTLY IN SEQUENCE, then no grand prize will be awarded.

Grand Prize (if awarded): $15,000, payable by check, provided by Odds on Promotions (OOP). 

A maximum of one (1) Grand Prize will be awarded.  It is possible that no Grand Prize will be awarded.  The odds of winning the Grand Prize are 1 in 100,000

Up to twenty (20) secondary prizes will be awarded, if one or more participant(s) correctly enter the winning codes for the secondary prizes:  $50 payable by cash or check.  Odds of winning a Secondary Prize are 1 in 100.

WMMR reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value.  Winners may not request prize substitution.  Prizes are non-transferable and may not be claimed or used by any person other than the winner.  Winners must claim prize by completing all required paperwork and providing photo identification in person at the WMMR offices as instructed by Station personnel.  Prizes not claimed as instructed will be forfeited.  Grand prize winner will be required to provide an affidavit of winner and may be required to take a polygraph examination to confirm eligibility and compliance with contest rules.

Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of an entrant or on an entrant's behalf, will result in the entrant's disqualification and forfeiture of any prize won.  WMMR reserves the right to rule ineligible listeners who, in WMMR’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMMR or its affiliates.  WMMR reserves the right to cancel, suspend and/or modify this contest and these Official Rules at any time, which changes will become effective upon announcement.  By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMMR and whose decisions with respect to all aspects of the contest are final and binding.  Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the WMMR studio, One Bala Plaza, Suite 424, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.  

As a condition to participating in this contest, each entrant agrees that any and all disputes that cannot be resolved between the the entrant and WMMR, and all causes of action arising out of or in connection with this contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and WMMR hereby waive any and all right to trial by jury. If any provision of these Official Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

Notwithstanding the previous paragraph, any and all disputes involving OOP or its underwriters shall be governed by the laws of the State of Nevada, without regard to its conflict of laws, and submitted to binding arbitration in accordance with the rules of the American Arbitration Association and pursuant to the provisions of the Nevada Uniform Arbitration Act. The venue for such arbitration shall be in Washoe County, Nevada. If for any reason there is litigation between an entrant and OOP or its underwriters, the exclusive jurisdiction and venue for such litigation is a state district court in Washoe County, Nevada.
